Civil libertarians are saying senior police and politicians should have saved their
praise of the DANIEL MORCOMBE investigation until after the accused's trial.

Queensland Council for Civil Liberties president MICHAEL COPE says comments made after
a man was charged on Saturday with murdering the Sunshine Coast boy, were ill-timed.

He says it's inappropriate to be heaping praise on the police which gives the implication
they have the right person and the right result.

Leading criminologist PAUL WILSON agrees it's a fine line, and says the presumption
of innocence must be kept.

The search for DANIEL'S body continues in muddy bushland on the coast today.

The accused, a Perth father-of-three, will fight charges of murder, deprivation of
liberty, child stealing, indecent treatment of a child and interfering with a corpse.

SYDNEY, Feb 18 AAP - Sylvester Stallone will probably be allowed to leave Australia
tomorrow, despite being under investigation for attempting to bring banned items into
the country.

The actor had several items confiscated by Customs officials who questioned him and
his entourage for two hours after he arrived at Sydney Airport late on Friday night.

Even if summonsed to appear in court, the star of the Rocky and Rambo films would not
necessarily be detained in Australia, a spokesman for the Australian Customs Service said.

"There is a range of options we can pursue in these circumstances," he said.

"Action could range from anything to seizure, a warning or a summons for a court appearance.

"But even in that case it may not be necessary for somebody to remain in the country.

"The investigation is ongoing and we are aware of Mr Stallone's travel movements.

"The material has to be identified and we have to look at all the options and the evidence
before deciding what action to take."

Customs are still holding the items, which were examined over the weekend.

The spokesman would not reveal the nature of the items, but it is believed they could
include body-building drugs which are banned in Australia.

Stallone flew to Australia from the United States for a lightning visit to attend last
night's Sydney premiere of Rocky Balboa, the sixth episode in his 30-year-old Rocky series.

He and his five-strong entourage were held until after midnight on Friday after routine
x-rays of his luggage found the suspicious items.

The 60-year-old dismissed the controversy.

"That was just a misunderstanding," he said as he walked the red carpet last night.

"Customs is doing a great job.

"I just didn't understand some of the rules here."

When asked on the red carpet what was in his luggage, he joked, "My wife."

He is due to leave Australia tomorrow.

People living in low lying areas in Roma .. in Queensland's southern inland .. are
being urged to leave their homes .. with 280 properties at risk of inundation when the
Bungil Creek peaks.

Bungil creek .. which runs through the town .. had been expected to peak at 7.5 metres
.. but it's now expected to a record level of 8.1 metres by late this afternoon.

Maranoa Regional Mayor ROBERT LOUGHNAN says text messages have been sent to residents
this morning via the State Disaster Management Network and council staff on the ground
are doorknocking at-risk homes.

Police says there is no mandatory evacuations at the moment but they are telling anybody
in low lying areas to leave.

Some localised flooding of streets has already been reported and motorists are advised
to exercise extra caution on roads.

Council is considering setting up an evacuation centre .. with a local disaster management
group holding a meeting at 10am (AEST) today.

A commemorative service will be held tomorrow for 31-year-old NICHOLAS EDWARDS .. after
his death following a shark attack near Gracetown in Western Australia's south-west.

The father of two was on his surfboard on Tuesday morning at South Point .. about 270
kilometres south of Perth .. when he was attacked.

Despite desperate efforts by fellow surfers and ambulance officers to keep him alive
.. he died after suffering a severe bite to his right leg.

Mr EDWARDS .. of Busselton, about 50 kilometres from Gracetown .. was trying to get
in one last surf before returning to his job as a miner in the WA Goldfields.

But even the PM can't beat actor Hugh Jackman, who has topped a poll as the drinking
buddy of choice.

A survey of more than 1,200 people found model Jennifer Hawkins came second - although
she was much more popular among men than women.

Mr Rudd came third, rating more highly among women wine-drinkers than the men.

He was followed by comedian Rove and actress Nicole Kidman. "Partner" came in 6th place,
just ahead of TV veteran Bert Newton.

The poll was commissioned by wine company Lindemans.

CANBERRA, April 22 AAP - There are renewed calls for all asylum seekers to be processed
on the mainland amid reports that another boat is on its way.

Authorities are reportedly preparing to intercept another asylum-seeker boat which
could reach Australia within days.

The federal government has not confirmed the report.

The Australian Greens want the government to ensure that any future asylum seekers
are brought to the mainland for processing.

Under current arrangements, people who do not reach the mainland are processed offshore,
which limits their legal claim for asylum, compared to those who make it to Australia.

The Greens said the boat which exploded and sank off the northwest coast of Australia
last week was an example of the two-class system the rules had created.

The 13 asylum seekers taken directly to Darwin for medical treatment were able to apply
for refugee status in Australia.

But 29 others who were first taken to an oil rig, excised from the mainland, will be
processed offshore.

"In this particular case, members of the same family could potentially be presented
with different legal entitlements," Greens senator Sarah Hanson-Young said in a statement.

"The inconsistency ... throws a spotlight on the arbitrary and unfair nature of these laws."

BRISBANE, Dec 17 AAP - Three people have been committed to stand trial on charges of
importing a commercial quantity of the main ingredient in the drug fantasy.

In the Brisbane Magistrates Court on Wednesday Steven Hill, 30, Candice Ruth Gray,
25, and Anthony Broad, 36, were committed to stand trial for importing the liquid fantasy
precursor from China to the Gold Coast in 2006.

Hill also was committed to stand trial for deprivation of liberty, robbery with violence,
common assault and unlawful use of a motor vehicle in relation to his alleged dealings
with Gold Coast dealer Ben Radcliff.

Finks bikie Yassar Bakir, the brother of mobile phone retail chain entrepreneur Ron
Bakir, will also have his committal hearing via videolink at 2.30pm (AEST) on Wednesday.

Bakir faces similar charges to Hill.

A date for the trial of Hill, Gray and Broad is yet to be fixed.

BRISBANE, Aug 12 AAP - Police are searching for a missing 46-year-old Gold Coast man.

James Richmond Syme, from Wongawallan, in the Gold Coast hinterland, was last seen
about 10am (AEST) yesterday.

Police have concerns for his welfare as he has a medical condition.

Mr Syme was reported missing by his son after he failed to arrive at work.

He is described as Caucasian, of solid build, 184cm tall with light brown/silver shoulder
length curly hair and blue eyes.

He has a tattoo of an eagle on his upper left arm and was wearing a black short-sleeve
polo shirt with black shorts.

He was driving a white Toyota Hilux utility truck with Queensland registration 553DOU.

In the rear of the ute was a green wheelie bin with the letter 's' spray-painted on it.

SYDNEY, Aug 31 AAP - The retirement of Ken Moroney as NSW police commissioner marks
the changing of the guard within the state's force, state Police Minister David Campbell
says.

Mr Moroney ended his 42-year career in the force today, with his successor Deputy
Commissioner Andrew Scipione to take over the top job from midnight tonight.

"Today marks a changing of the guard for NSW Police and I am confident it heralds a
bright future for the force," Mr Campbell said.

He was sad to see Mr Moroney leave as he was a man who had shown great dedication to
the force, he said.

Deputy Commissioner specialist operations Terry Collins has announced he will stay
on with the NSW Police Force for an extra six months and will then retire.

He and Mr Moroney have more than 80 years policing experience between them.

Mr Campbell said Mr Collins' departure and Mr Scipione's promotion would see two senior
vacancies become available.

"This is a very exciting time for the NSW Police and an opportunity for some of our
more experienced officers to step up into these leadership positions," he said.

NSW Opposition Leader Barry O'Farrell echoed Mr Campbell's remarks, saying Mr Moroney
had shown outstanding leadership as commissioner over the past five years.

"Ken Moroney deserves the accolades he's receiving, but above all he deserves a break
from politicians and the media," he told reporters.

"I wish him a long, happy and fruitful retirement."

SYDNEY, April 17 AAP - The first of 300 Australian special forces soldiers have arrived
in Afghanistan, with the full deployment to be completed by the end of May, Defence Minister
Brendan Nelson says.

Australia is deploying the extra soldiers to the country's south-central region ahead
of an expected new Taliban offensive.

Australia currently has some 500 troops based at Tarin Khowt in the country's Oruzgan
province, comprising an engineering group and their security detail.

Troop numbers will reach 950 by the middle of this year and peak at 1,000 by mid-2008.

"We've already sent a small number to establish the basic logistics for the new operations,"

Dr Nelson told reporters in Sydney.

"We will have progressive deployments over the next six weeks and we would expect them
to be fully deployed by the end of May."

Dr Nelson said he expects there will be two more "significant" send-offs of Australian
troops bound for Afghanistan.

CANBERRA, Dec 16 AAP - The Victorian and federal governments have agreed to provide
an extra $800,000 to help those hit by the current bushfire emergency in the state.

Bushfires in Victoria's Gippsland and north-east have claimed one life, destroyed at
least 15 homes and burnt out thousands of hectares of bushland and forestry.

Prime Minister John Howard said today that he and Victoria's Premier Steve Bracks had
agreed to provide more than $800,000 in additional funding to help families, business
and primary producers recover "from the devastating bushfires."

He said the agreement established a $700,000 community recovery fund with equal contributions
from the state and commonwealth.

This is over and above the support the commonwealth government provides under the enhanced
natural disaster relief arrangements.

Mr Howard said the community recovery fund would be used to address the needs of the
community as they arise and to help the region to recover fully from the fires.

The funding would support grants of up to $15,000 for charities, small business and
primary producers to assist with costs that are not covered by insurance arrangements.

"The commonwealth and Victoria have also agreed to contribute $50,000 each to the Red
Cross Bushfire Appeal to assist families, small business and communities affected by the
bushfires in Victoria," Mr Howard said.

He said the commonwealth and Victorian governments would consider further assistance
for the regions once the full extent of the damage from the current bushfire has been
assessed.

MELBOURNE, Aug 9 AAP - Former wards of the state have met Victorian Premier Steve Bracks
before receiving a formal apology from him in parliament for the abuse and neglect they
suffered in institutions.

"To be without a family, to be without a community, to be denied all the enrichment
and nourishment that a family and a community can give you and to be shunted aside and
to be put aside as if you are in a prison effectively is just an outrage which we need
to apologise for," Mr Bracks said after meeting abuse victims.

"We should be big enough to say the state was wrong at the time when these events were
happening in state institutions."

About 90,000 Victorian children were put in institutions by their families or other
agencies between 1928 and 1992.

Institutions were run either by the state government or by religious groups such as
the Salvation Army.

Mr Bracks said the apology today was intended for all state wards because all had experienced
abuse in the institutions.

"You can't ignore the fact that within those institutions you may not have been an
individual who suffered that particular abuse but a large amount of people did," he said.

The apology follows a 2004 federal government report recommending all states acknowledge
their role in running the institutions where children were neglected or harmed.

Under changes to Victorian law two years ago, an official apology is not an admission
of liability.

Mr Bracks said the government had settled about 60 cases over the past 10 years, paying
out $4.3 million to abuse victims.

Further claims would also be dealt with on a case-by-case basis but there would be
no cap set on the compensation pay-outs.

Mr Bracks said it was appropriate for his government to issue the apology even though
the abuse and neglect had occurred in earlier times, under previous governments.

One of the victims, Ken Carter, now a 61-year-old businessman, said today's apology
meant a lot for him.

"You know what the problem is in this country? People don't understand what apology
is. We've got (Prime Minister John) Howard who won't apologise on behalf of previous governments
for the treatment of the Aborigines," he said.

"As I said to Steve (Bracks) before: `That wasn't hard was it Steve?' That does means a lot."

Although Mr Carter is now a successful entrepreneur, employing more than 100 people,
he experienced 18 years of misery as an orphan in both a state-run home and a Salvation
Army facility he described as "like a concentration camp."

"The most damning thing about all this is they never told me about my brothers and
sisters. That's the thing I couldn't handle," he said.

Senator ELLISON says the project will develop a rapid and cost effective process for
DNA testing able to be used outside laboratories.

He says current techniques for DNA profiling are relatively slow and expensive.

MELBOURNE, Aug 2 AAP - The Victorian government has moved to protect the awards and
conditions of the 250,000 workers on the state payroll from the federal governments's
proposed workplace reforms.

But Premier Steve Bracks admitted the state government was powerless to protect the
90 per cent of Victorian workforce who are in the private sector.

In a sweeping attack on the proposed industrial relations shake-up, Mr Bracks said
the federal government did not have a mandate to change the unfair dismissal laws, nor
to strip away entitlements and conditions including meal breaks, penalty rates, standard
hours of work and long-service leave.

"Those rights, those minimum conditions under award will be stripped away under the
industrial relations system which is being proposed by the federal government," Mr Bracks
told reporters.

Mr Bracks vowed to do "everything we can, by whatever means we can" to protect existing
award entitlements of state sector employees.

"We'll do that through the normal arrangements we have as an employer.

"We'll also seek and examine what legislative recourse we've got to examine whether
that can be further reinforced through legislative means."

However, Mr Bracks warned the federal government would use its control of both houses
of parliament "to thwart the states and their attempts to protect and support workers
including public sector workers".

Victoria is unique among the states because it has already ceded its IR system to the
federal government under the previous Kennett government.

Nevertheless, Mr Bracks said the Victorian government had no plans to recover a state-based
IR system that could protect private sector employees from the reforms.

"We are not going to give false hope. This has to be won in the court of public opinion,"

he said.

The Victorian premier said the issue of a High Court challenge to the proposed changes,
which are being enforced through corporations law, would be on the agenda when state and
territory industrial relations ministers meet in Melbourne this Friday.

Mr Bracks said there was a "very strong chance" a High Court challenge by the Labor
leaders would go ahead.

"Other states have a similar resolve to the resolve here in Victoria.

"That is, we want to protect working families. We want the economy working for working families.

"We don't believe this protects working families and clearly that's one of the options
open to our state and other state and territory governments."

The federal government plans sweeping changes, including scrapping state systems in
favour of a single national IR regime, and moving more workers onto individual agreements.

Matters like long service leave, superannuation, jury service and notice of termination
will be removed from awards.

Under the planned reforms, employment contracts and agreements will have to meet only
five basic minimum standards - annual leave, personal leave, parental leave, sick leave
and working hours.

CANBERRA, Feb 13 AAP - Prime Minister John Howard is under increasing pressure today
to apologise to Cornelia Rau after Treasurer Peter Costello said he was sorry the mentally
ill woman was locked up as a suspected illegal immigrant.

Mr Costello is the government's first minister to offer his apologies.

He said that he, and the federal government, were sorry for what happened to 39-year-old
Ms Rau who was detained for ten months.

But Opposition Leader Kim Beazley demanded the apology come from Prime Minister John
Howard because, he said, the starting point for blame in what went wrong with Ms Rau's
case was the federal government.

His call was supported by the Australian Democrats who also want a wider inquiry than
that set up to examine Ms Rau's case.

The federal government announced last week that former police chief Mick Palmer would
conduct a private inquiry into the mix-up that placed the German-born woman who has schizophrenia
in immigration detention for 10 months.

There has been widespread criticism of the closed-door inquiry's lack of judicial powers
and the narrowness of its terms of reference - it is only looking at the case of Ms Rau.

The Democrats want a broader inquiry to look at the issue of mental patients detained
in jails and immigration centres.

Mr Costello said today the system failed Ms Rau.

"I am sorry that it happened. I think the government is sorry that it happened.".

"The system failed Cornelia Rau and it's regrettable.

"I'm sure all those that are responsible will say to themselves it should never have
happened and we should never let it happened again."

Mr Costello said it was important to ensure no similar mistake happened again.

German-born Ms Rau is being treated in an Adelaide psychiatric unit for schizophrenia
after being released from South Australia's Baxter immigration detention centre less than
two weeks ago.

The Australian resident, who came to Australia with her family when she was just 18
months old, spent six months in a Queensland jail after being found in north Queensland.

She was sent to Baxter in October, where she was held for a further four months.

Mr Beazley was unimpressed with Mr Costello's apology.

"Sorry for what happened? I'm sorry for what happened but the starting point is, who's
responsible is the federal government and that requires an apology," he said.

"So if that's as close as their going to get, then I guess that's as close as they're
going to get to it, but it's not enough.

"It's an extraordinary story and one which, at a starting point in its resolution,
requires a direct apology from the Prime Minister to the poor person who has suffered."

A brief statement released later by Ms Rau's sister Christine Rau and brother-in-law
John Macdonald said:

"We appreciate the gesture but now await the outcome of the Mick Palmer inquiry before
commenting further."

Australian Democrats leader Lyn Allison said Ms Rau's family had said it would welcome

Openwave Systems Inc. Investor Pursues Shareholders' Rights Claim Against Merrill Lynch After Learning of the $100 Million Settlement With the New York Attorney General.

WASHINGTON -- Finkelstein, Thompson & Loughran has filed a securities fraud class action lawsuit against Merrill Lynch & Co., Inc. and the head of its Internet group, Henry Blodget, on behalf of purchasers of Openwave Systems Inc. securities between October 16, 2000 and August 13, 2001, inclusive (the "Class Period").

The Complaint, filed in the United States District Court for the Northern District of California, alleges that Merrill Lynch and its well-known Internet stock analyst Henry Blodget violated the federal securities laws by knowingly issuing false and misleading analyst reports regarding these "new economy" companies during the Class Period. Based on e-mails and other internal Merrill Lynch communications, which were made public as a result of the investigation conducted by the New York State Attorney General, Eliot L. Spitzer, the Complaint alleges that Defendants failed to disclose a significant conflict of interest between their investment banking and research departments. Colorado-Based Online Vacation Auction Firm Gets More Venture Capital.(Knight Ridder/Tribune Business News)

Jun. 7--Bid4Vacations.com has received another healthy round of venture capital, despite business-to-consumer Internet companies losing favor with investors.

Rick Patch, a partner from one of the five Colorado venture capital firms that together infused $4.5 million into the Web-based vacation auction company, summed it up this way: People are passionate about their vacations.

"People are flooding the site, and there is smoke coming out of it," said Patch, a partner with Boulder-based Sequel Venture Partners. "We're already over the number of registered users that we expected to have at the end of the year."

Westminster-based Bid4Vacations advertises up to 80 percent discounts on vacations, including hotel packages and cruises and only specifies a six-month window for travel, Patch said. The company has more than 1 million registered members, who bid for vacation bargains on the company's Web site.

Getting funding was possible because of the company's unique Internet product, said Pamela Bergeson, the company's founder and president.

"The Internet allows different people to bid on packages to get a really good deal, and that's something that a travel agent couldn't duplicate," Bergeson said.

Catalyst Partners, Stonebridge Companies, iSherpa.net, Sequel Venture Partners and Ventura Inc. contributed to the recent round of financing.

The company will use the money to launch new programs, especially a co-branding version on travel Web sites that don't offer auctions, Bergeson said. Co-branding will allow other travel sites to offer vacation auctions that appear to be their own but are run by Bid4Vacations. Bid4Vacations offers a revenue share to those companies when someone buys a travel package.

"We're going hog-wild on this affiliate program," Bergeson said. "Instead of paying portals for big advertising dollars up front and producing no results, we only pay on performance."

Bid4Vacations.com moved from Louisville to Westminster in July and now has 43 employees. The company began in April 1999.

Bid4Vacations' Web site received more than 832 million unique visitors per month in May.

The company announced its $2 million first round of venture capital from Sequel Venture Partners in August.
